Agreement On The Privileges And Immunities Of The Iaea

The Government shall grant the IAEA the permanent use and occupation of a headquarters, as may be established from time to time in supplementary agreements between the IAEA and the Government, and the IAEA shall agree by the Government. The privileges and immunities granted by this Article shall be granted in the interest of the IAEA and not for the personal benefit of individuals The immunity of IAEA officials shall be waived by the IAEA in cases where immunity may be impeded and waived without prejudice to the interests of the IAEA. In all cases where such privileges and immunities arise, the official concerned shall immediately report to the Director-General, who, where appropriate, shall decide, in consultation with the Governing Council, whether or not to waive them. In the case of the Director-General, the Governing Council shall have the right to waive immunity. The privileges and immunities granted by this Article shall be granted in the interest of the IAEA and not for the personal benefit of the individuals themselves. The IAEA shall, in any event, grant immunity granted to such persons under this Article, in the event that the IAEA considers that immunity would constitute an obstacle to judicial proceedings and could be waived without prejudice to the interest of the IAEA. Persons who are entitled to diplomatic privileges and immunities under Articles 30, 31 or 39 shall not be required to leave the Republic of Austria other than in accordance with the usual procedure applicable to members of comparable rank of the Staff of the Heads of Diplomatic Representation accredited to the Republic of Austria. A Deputy Director General or a senior official of the IAEA, when acting on behalf of the Director General during his absence, shall enjoy the same privileges and immunities, immunities and facilities accorded to the Director General; and each governor and resident representative to the IAEA shall be entitled in the Republic of Austria to the same privileges and immunities granted by the Government to the heads of diplomatic representation accredited to the Republic of Austria. . .
